Thorough Case Preparation

Birth injury cases are complex. The medical causes and life-long effects of your child's birth injury require the highest degree of case preparation. Our lawyers take testimony and depositions of every health care provider involved in your child's case. This includes prenatal, interpartum (during delivery) and postnatal care providers. We gather all related medical records and supporting documents.

In our effort to prove liability, we only consult medical experts at the top of their fields. We discuss your child's condition and prognosis. We also discuss the life care plan, which is developed by qualified medical specialists who evaluate your child's medical needs.

With 35 years of experience handling birth injury cases, we understand the importance of expert testimony and life care plans. They can help juries gain a clearer understanding of your child's injury and medical and financial needs.

Cerebral Palsy

Cerebral Palsy is a devastating condition caused by a lack of oxygen during delivery. This permanent brain injury is incurable. Cerebral palsy can destroy your child's vision, ability to speak, walk, eat and take care of themselves.

The level of severity determines your child's long-term medical needs and accommodations for life. These accommodations can include wheelchairs, special communication equipment, handicapped vans, housing alterations or additions, special beds and a host of other equipment and services. Our goal is to help your child receive the best medical care and a fair financial settlement for their birth injury.

In a recent obstetrical case, a baby was deprived of oxygen and as a consequence had cerebral palsy for the rest of her life. A hospital in Columbus, Ohio said that the doctor supervising the resident physicians providing care was on top of her care. They initially argued that the electronic monitoring strip showed a health baby, not one who was becoming progressively more and more damaged as the labor went on. We suspected the supervising doctor was sleeping.

When the supervising doctor went off duty at 7:00 in the morning, a new supervising physician came on who immediately realized the problem and took steps to deliver the baby. This physician was also addicted to the truth – he told in plain and simple terms how his colleague had misinterpreted the fetal monitor tapes and caused injury to the baby. Without taking that deposition and without exhaustive hours of preparation for it, the truth would not have come out. That baby is now being taken care of because the case settled for $5 million, which money went into a lifelong trust to take care of her.
